Markham, Canada<\/strong> \u2013 The Tamil Rights Group (TRG) has submitted a Parliamentary Petition to Canada\u2019s House of Commons in support of its Communication under Article 15 of the Rome Statute to the Office of the Prosecutor at the International Criminal Court (ICC). The Communication, which can be read in full here<\/a>, requests a preliminary examination into crimes against humanity of deportation and persecution committed against Eelam Tamils within the territories of state parties to the ICC.<\/p>\n\n\n\n

The Parliamentary Petition, which was presented to the House of Commons today with the support of MP Garnett Genuis (Sherwood Park\u2014Fort Saskatchewan) and MP Jasraj Hallan (Calgary Forest Lawn), calls upon the Government of Canada, as a State Party to the Rome Statute of the International Criminal Court, and relying on the evidence and legal argumentation contained in TRG\u2019s Article 15 Communication, to refer the Situation to the ICC so that, among other things, the Prosecutor can initiate an investigation without the need to seek authorization from a pre-trial chamber.<\/p>\n\n\n\n

This Petition comes on the heels of the Canadian Parliament unanimously adopting a motion to mark May 18 of each year as Tamil Genocide Remembrance Day, as well as Canada\u2019s recent precedent-setting move to refer the situation in Ukraine to the ICC.<\/p>\n\n\n\n

\u201cCanada has become the first national Parliament to mark a Tamil Genocide Remembrance Day and so boldly recognize what happened to Eelam Tamils as a genocide. Such recognition, however, necessitates action, which is why we are calling upon the Government of Canada to assist the Tamil community\u2019s fight for justice, including at the ICC. By referring the Situation to the ICC, Canada can play a leadership role in ensuring that the Prosecutor initiates an investigation into crimes against humanity committed by the Sri Lankan state – similar to how Canada recently took a leadership role in referring the Situation in Ukraine to the ICC. This will also align Canada with calls from the United Nations High Commissioner for Human Rights in January 2021 which looked to member states to become involved in working to end the impunity surrounding the Sri Lankan armed conflict, both by utilising the principle of universal jurisdiction to initiate prosecutions in foreign domestic courts, and by taking steps toward seeking justice at the international level, including at the ICC. \u201d \u2013 Katpana Nagendra, Secretary and Spokesperson, Tamil Rights Group<\/strong><\/p>\n\n\n\n

\u201cMotions in the House of Commons are only meaningful if they lead to concrete action. We have seen a number of unanimous consent motions related to the rights of Tamils in Sri Lanka adopted in the House of Commons, but the government has failed to follow that up with advocacy at the international level.
