Markham, Canada \u2013<\/strong> Today, The Tamil Rights Group (\u201cTRG\u201d) filed its factum intervening at the Court of Appeal for Ontario (\u201cOCA\u201d) in the matters of Sri Lankan Canadian Action Coalition et al. v. Her Majesty the Queen in Right of Ontario<\/em> and Neville Hewage v. Attorney General of Ontario<\/em> (collectively, the \u201cApplicants\u201d). The appellate has permitted TRG leave to intervene in these constitutional challenges against Tamil Genocide Education Week Act, 2021 <\/em>(\u201cTGEWA\u201d).<\/p>\n\n\n\n

On June 28, 2022, the Honourable Judge J.T. Akbarali of the Superior Court of Justice upheld the constitutionality of the TGEWA and found that it is intra vires the province and does not violate the applicants’ ss. 2(b) or s. 15 Charter rights and appropriately dismissed both applications. However, the Appellants are appealing this decision to the OCA on the grounds that Justice Akbarali failed to address their arguments in depth and that she erred in law, misinterpreting evidence, considering irrelevant facts, and failing to consider relevant facts.<\/p>\n\n\n\n

In their appeal, the Appellants continue to not only seriously misrepresent the purpose of the TGEWA but also keep making false and misleading statements on the facts surrounding the genocide of the Tamil people in Sri Lanka. By intervening in the appeal, TRG will continue to ensure that the OCA is provided with the Tamil perspective on the conflict in Sri Lanka and to show that the \u201cacts of genocide\u201d referred to in the Preamble to the TGEWA are rooted in facts and in the actual history.<\/p>\n\n\n\n
