Markham, Canada<\/strong> \u2013 <\/strong>District Judge Mr T. Saravanaraja from Mullaitivu in Sri Lanka has been forced to resign and flee the country due to the ominous threats to his life and intimidation from elected representatives and other officials in the country. In his letter of resignation which has now been published in the media, the esteemed judge who has recently ruled on cases relating to an ancient Tamil Hindu religious site in Kurunthurmalai and a remembrance event to commemorate Lt Col Thileepan, had written to the Sri Lanka Judicial Services Commission that he was resigning due to \u201cthreat to my life and due to lot of stress\u201d forced upon him.<\/p>\n\n\n\n

Tamil Rights Group (TRG) expresses grave concerns regarding the continued attempts in Sri Lanka to pervert the course of justice. TRG vehemently condemns this latest threat where a member of the judiciary performing his impartial duties to uphold the law has been targeted. This persecution furthers the aims of the majoritarian Sinhala \u2013 Buddhist state to marginalise the Tamil and Muslim people of the island.<\/p>\n\n\n\n

Mr Saravanaraja was a senior judge and magistrate in the war torn Mullaitivu district, where Tamils are still suffering from the effects of the civil war and the atrocity crimes perpetrated against them by the Armed Forces and Governments of Sri Lanka (GoSL). As the Tamil citizens struggle to seek justice and accountability, the military occupation and exacerbated human rights violations continue in the North and East of Sri Lanka, including in Mullaitivu.<\/p>\n\n\n\n

Some time ago, the Mullaitivu court with Judge Saravanaraja presiding had ordered the removal of all new construction, including the illegally built shrine on Kurunthurmalai, a hill top site that already contained an ancient Tamil Hindu temple, the revered Athi Aiyanar temple. Despite this court injunction, Sinhala Buddhist monks with the active help of the Archaeological Department continued to construct an illegal Buddhist shrine on the temple land, in blatant disregards of the law. Separate to the above ruling, Judge Saravanaraja had also visited a mass grave site in Kokkuthodavai, Mullaitivu district with the area police and ordered excavations. In this context, it should be noted here that the Kokkuthodavai site like many other mass graves that have been discovered are believed to contain bodies of Tamils killed extrajudicially, for which the GoSL has refused to conduct internationally supervised impartial investigations.<\/p>\n\n\n\n

The independence of the judiciary together with the rule of law has been severely eroded in Sri Lanka. While Judge Saravanarajah has been hounded continuously through racist comments and disgraceful used parliamentary privilege to conduct personal attacks against him by MPs such as Sarath Weerasekera, he has also been subjected to severe intimidation and threats to life. Further, it has been reported that he was summoned by the Attorney General to his office on 21 September 2023 and that pressure was exerted on him to amend his judgments regarding the Kurunthurmalai case.<\/p>\n\n\n\n

This type of intimidation and systematically planned action to pervert the course of justice is nothing new in Sri Lanka. This has been a strategy adopted by successive Sinhala-Buddhist majoritarian governments to allow the continued human rights abuses undertaken to marginalise and subjugate Tamils, driven by the majoritarian mindset that the country belongs to the Sinhala-Buddhist only.<\/p>\n\n\n\n
