Markham, Canada – Tamil Rights Group (TRG) is a newly established international not-for-profit organisation, headquartered in Markham, Canada, that seeks to further strengthen advocacy efforts for transitional justice and accountability for the Tamils of Lanka through international law measures, expanded global diplomacy, and defending their civil liberties within Sri Lanka. To this new chapter, TRG brings together a multigenerational team, deep networks within civil society in the traditional homelands and across the diaspora, and activists directly connected to the struggle for Tamil rights since the early 1970s.
TRG functions as a platform for active collaboration between different generations of activists, experts, diaspora communities, and the international community to carry forward the survivor-centred narrative of holistic transitional justice process for the Tamils of Lanka. TRG seeks to join with the international human rights champions to ensure reparative justice and guarantees of non-recurrence through international judicial mechanisms to address accountability, end post-war conflicts, help institute reforms, and protect the human rights and freedoms of the Tamil people and other targeted groups in Sri Lanka.
The systemic structural genocide of the Tamils that culminated in the Mullivaikal massacre in May 2009 was rampant with international war crimes and crimes against humanity, including the multitude of violations in the “No-Fire Zones” by the Sri Lankan armed forces. The years of violations of international human rights law, anti-Tamil and anti-Muslim pogroms, enforced disappearances, summary executions, state-sponsored paramilitary killings, arbitrary arrests, extended incarcerations, torture, and gender-based violence have still not been accounted for. This culture of impunity has become the state policy and institutionalised in the autocratic presidency.
Despite assurances of successive governments and make-belief guarantees to carry forward transitional justice and accountability mechanisms, there has been no substantial progress on the vital fronts of United Nations Human Rights Council (UNHRC) resolutions. Instead, the current Government of Sri Lanka headed by Gotabaya Rajapaksa has unilaterally withdrawn Sri Lanka from the UNHRC resolutions that itself co-sponsored in 2015. The new regime has vowed to protect members of the armed forces from any accountability, thus effectively reneging on judicial process, and the responsibilities the government has towards its own people, and to the international community and in 2019, finally renounced all the official undertakings given to the UN by Sri Lanka by the previous regime six years earlier.
TRG’s formation comes at this critical juncture in time and seeks to achieve transitional justice through international, impartial, and independent legal mechanisms to assist in the investigation and prosecution of persons responsible for the most serious crimes committed during the war in Sri Lanka under international law. TRG also anticipates promoting universal jurisdiction and lawfare in their respective countries for the victims in the yesteryears for violations under international law.
The mandate of the TRG also includes pursuing expanded global diplomacy through advocating with governments and international bodies that respect human rights and justice. TRG will also support any civil liberties network in Sri Lanka which would provide legal support for the public, advocate for reforms, provide a platform for the Tamil community and others to engage in discourse, and come up with sustainable political solutions. TRG emphasizes that the structural genocidal framework which has provided fertile ground for further violations and abuses must be curtailed through the intervention of the UN as well as established and emerging mechanisms to keep states accountable.

மார்க்கம், கனடா – தமிழர் உரிமைக்கான குழுமமானது மார்க்கம், கனடாவில் தலைமைச்செயலகத்தைக் கொண்டு புதிதாக ஆரம்பிக்கப்பட்டுள்ள ஒரு இலாபநோக்கற்ற நிறுவனமாகும். அது அனைத்துலக சட்ட நடவடிக்கைகள், அகண்ட உலகளாவிய இராஜதந்திர செயலாட்சி, இலங்கையிலே அரசியல் உரிமைகளைப் பாதுகாத்தல் ஆகிய பொறிமுறைகள் ஊடாக, இலங்கையில் தமிழர்களுக்கான நிலைமாறுகால நீதிக்கும், பொறுப்புக்கூறலுக்குமான பரிந்துரைச் செயற்பாடுகளை மேலும் வலுப்படுத்த முனைகிறது. இந்தச் செயற்பாட்டுக்காக, தமிழர் உரிமைக்கான குழுமமானது முதலாவது மற்றும் இளைய தலைமுறைகளைச் சேர்ந்த செயற்பாட்டாளர்களையும், தாயகத்தில் சமூக அமைப்புகளுடனும் புலத்தில் சமூக உரிமைச் செயற்பாட்டாளர்களுடனுமான வலுவான தொடர்புகளையும், தமிழ்த் தேசிய விடுதலைப் போராட்டத்துடன் எழுபதுகளிலிருந்து தொடர்புபட்டிருந்த செயற்பாட்டாளர்களையும் ஒருங்கிணைத்துள்ளது.
இலங்கையிலே தமிழர்களுக்கான, களத்திலுள்ளவர்களை மையமாகக் கொண்ட, ஒருமுகப்படுத்தப்பட்ட நிலைமாறு நீதிக்கான செயற்பாடுகளை முன்னெடுக்கவென பல்வேறு தலைமுறைகளையும் சேர்ந்த செயற்பாட்டாளர்களும், புலம் பெயர் தமிழர் குமுகங்களும், அனைத்துலக குமுகமும் இணைந்து செயலாற்றுவதற்கானதொரு தளமாக தமிழர் உரிமைக்கான குழுமம் விளங்கும். பொறுப்புக்கூறல், போரின் பின்னரான பிணக்குகளை முடிவுக்குக் கொண்டுவரல், கட்டமைப்புரீதியான மறுசீரமைப்புகளை நிறுவ உதவுதல், தமிழரதும் ஏனைய குறிவைத்துத்தாக்கப்படும் குமுகங்களினதும் மனித உரிமைகளையும் சுதந்திரங்களையும் பாதுகாத்தல் ஆகிய விடயங்களை அனைத்துலக சட்டப் பொறிமுறைகள் மூலம் அணுகி, இழப்பீட்டுநீதியை வழங்கவும் மீள் நிகழாமைக்கான உத்தரவாதத்தைப் பெறவும் என அனைத்துலக அளவில் மனித உரிமைச் செயற்பாடுகளை முன்னெடுப்போருடன் கைகோர்ப்பதே தமிழர் உரிமைக்கான குழுமத்தின் நோக்கம்.
தமிழர்களுக்கெதிரான, கட்டமைப்புரீதியாக ஒருங்கிணைக்கப்பட்ட இனவழிப்பானது – சர்வதேச மனித உரிமை மீறல்களும், இலங்கை அரச படைகளால் பாதுகாப்பு வலயத்திற்குள் பலமுறைகள் குண்டு வீசப்பட்டதுட்பட்ட மானிடத்திற்கெதிரான குற்றங்களும் மலிந்திருந்த – முள்ளிவாய்க்கால் படுகொலைகளில் மே 2009ல் உச்சம் பெற்றது. ஆண்டாண்டுகளாக தொடர்ந்த அனைத்துலக மனித உரிமைச் சட்ட மீறல்கள், தமிழர்களுக்கும் முஸ்லிம் மக்களுக்கும் எதிரான ஒருங்கிணைக்கப்பட்ட வன்முறைகள், காணாமலாக்கப்பட்டோர், சட்டத்திற்குப் புறம்பான கொலைகள், அரசசார்பு ஆயுதக்குழுக்கள் மேற்கொண்ட கொலைகள், காரணமற்ற கைதுகள், நீடித்த சிறைப்படுத்தல்கள், சித்திரவதைகள், பால்சார் வன்முறைகள் என எவற்றுக்குமே இதுவரை பொறுப்புக்கூறப்படவில்லை. இந்தத் தண்டனைப்பயமின்றி இயங்கும் பண்பாடு தற்போது அரச கொள்கையாகி ஏகாதிபதிபோல் இயங்கும் அரச தலைவரால் கட்டமைப்பாக உள்வாங்கப்பட்டுள்ளது
அடுத்தடுத்துவரும் அரசுகள் நிலைமாறு நீதிக்கானதும் பொறுப்புக்கூறலுக்கானதுமான பொறிமுறைகளை முன்னெடுக்கப்போவதாக உறுதிமொழிகளையும், பொய் வாக்குறுதிகளையும் வழங்கிவந்துள்ளபோதும், ஐக்கிய நாடுகள் மனித உரிமைகள் செயலகத்தால் நிறைவேற்றப்பட்ட முக்கியமான தீர்மானங்கள் தொடர்பில் எந்தக் குறிப்பிடத்தக்க முன்னேற்றமும் இதுவரை ஏற்படவில்லை. மாறாக, அரச அதிபர் கோத்தபாய இராஜபக்ஸவின் தலைமையிலான தற்போதைய இலங்கை அரசாங்கம், 2015ல் தானும் கைச்சாத்திட்ட ஐக்கிய நாடுகள் மனித உரிமைகள் செயலகத்தின் தீர்மானங்களிலிருந்து ஒருதலைப்பட்சமாக வெளியேறியுள்ளது. எந்த வகையான பொறுப்புக்கூறலிலிருந்தும் அரச படையினரைப் பாதுகாக்கப்போவதாக புதிய அரசு அறிவித்ததன் மூலம், சட்ட ஒழுங்குச் செயற்பாட்டுக்கும், தனது குடிமக்களுக்கும், அனைத்துலக சமூகத்திற்குமான ஒரு அரசின் கடமைகளை மறுதலித்துள்ளதோடு, ஆறுவருடங்களுக்குமுன் முந்திய அரசால் ஐக்கிய நாடுகளுக்கு உத்தியோகபூர்வமாக வழங்கப்பட்ட வாக்குறுதிகளையும், 2019லே இறுதியாகக் கைவிட்டுள்ளது.
இந்த முக்கிய தருணத்திலேயே தமிழர் உரிமைக்கான குழுமம் உருவாக்கப்பட்டுள்ளது. அனைத்துலக, பக்கச்சார்பற்ற, சுயாதீனமான சட்டப் பொறிமுறைகள் மூலம் இலங்கையிலே இடம்பெற்ற அனைத்துலக சட்டங்களை மீறும் மிக மோசமான குற்றச்செயல்களுக்குப் பொறுப்பானவர்களை இனங்கண்டு தண்டனை வழங்க உதவுவதன்மூலம் நிலைமாறு நீதியை நிலைநாட்ட அது விழைகிறது. கடந்த காலங்களிலே அனைத்துலக சட்டங்கள் மீறப்பட்டதால் பாதிப்புக்குள்ளானவர்கள், அவர்கள் வாழும் அனைத்துலக நாடுகளிலேயே நீதி பெறுவதற்கான சட்ட ஒழுங்குகளில் உதவவும் தமிழர் உரிமைக்கான குழுமம் திட்டமிட்டுள்ளது.
மனித உரிமைகளுக்கும் நீதிக்கும் மதிப்பளிக்கும் அரசுகளுடனும் அனைத்துலக அமைப்புகளுடனும் பரிந்துரைச் செயற்பாடுகளை மேற்கொள்வதன் மூலம் அனைத்துலக அரசியற் செயலாட்சியை விரிவுபடுத்துவதும் தமிழர் உரிமைக்கான குழுமத்தின் நோக்கங்களில் ஒன்று. இலங்கையிலே, பொதுமக்கள் உரிமைகளுக்கான சட்ட ஆதரவு வழங்கும், அரசியல் சீரமைப்பை வலியுறுத்தப் பரிந்துரையை மேற்கொள்ளும், நிலையான அரசியல் தீர்வைநோக்கிய கலந்துரையாடல்களிலே தமிழர்களும் தமிழரல்லாதோரும் ஈடுபட களம் அமைத்துக் கொடுக்கும் பொதுமக்கள் உரிமைகள்சார் குழுக்களிற்கு தமிழர் உரிமைக்கான குழுமம் ஆதரவு வழங்கும். மேலதிக உரிமை மீறல்களுக்கும் துன்புறுத்தல்களுக்கும் களமமைத்துக்கொடுத்துக்கொண்டிருக்கும் இலங்கையின் கட்டமைப்புரீதியான இன அழிப்புச் செயற்பாடு, ஐக்கிய நாடுகளின் தலையீடு மூலமாகவும், நாடுகளின் பொறுப்புக்கூறலை உறுதிசெய்யவென ஏற்கனவே ஏற்படுத்தப்பட்டுள்ள மற்றும் புதிதாக உருவாகிவரும் பொறிமுறைகள் ஊடாகவும் தடுத்து நிறுத்தப்படுவதன் முக்கியத்துவத்தை தமிழர் உரிமைக்கான குழுமம் வலியுறுத்துகிறது.
